Dushanbe, 28.08.2015. (NIAT «Khovar»). – «The Islamic Renaissance Party of Tajikistan (IRPT) is no longer the all-Republican party» — announced the Ministry of Justice of the Republic.

The Ministry of Justice of the Republic of Tajikistan in accordance with article 20 of the Law of the Republic of Tajikistan «On political parties» has sent a Notification to the Islamic Renaissance Party of Tajikistan and demanded from the leadership of the party to cease the illegal activity of the party. As stated in this notification, in accordance with article 3 of the Law of the Republic of Tajikistan «On political parties», Republican political parties must have a primary party organizations in most towns and districts.

According to documents submitted to the Ministry of Justice, in 58 cities and districts of the Republic the primary party organizations of IRPT ceased operations. Therefore, the IRPT cannot represent itself all-Republican party and hold conventions.

The notification also states that the IRPT is registered as a Republican party and in accordance with article 10 of the Law of the Republic of Tajikistan «On political parties» obliged to comply with the requirements of the Constitution of the Republic of Tajikistan, other regulatory legal acts of the Republic of Tajikistan. Despite this, «the IRPT recently allows systematic violations», — it is stated in the notification of the Ministry of Justice.

The Ministry of Justice of the Republic of Tajikistan reports that to this competent state authority are presented copies of the decisions of the local structures of the party on the termination of their activities in the cities and districts of the Republic, according to which party members voluntarily ceased membership in the IRPT.

In General, the Ministry of Justice has received 76 acts and protocols of primary party organizations of IRPT of the 58 cities and regions connected with the termination of their activities.

The Islamic Revival Party of Tajikistan was registered as a Republican Party and in accordance with article 10 of the Law of the Republic of Tajikistan On political parties is required to comply with the rules of Constitution and other legal acts of the Republic of Tajikistan.
However, in last time the Islamic Revival Party of Tajikistan admits wrongdoing.
1. The copies of the resolution of the municipal structure of Islamic Revival Party of Tajikistan  on termination activities in cities and regions was available to the Ministry of Justice of the Republic of Tajikistan and original copies were moved to the Supreme Council of the Islamic Revival Party of Tajikistan. (IRP). The membership of the Party was terminated voluntary.
In general 76 acts and Minutes of the origin structure of the  Islamic Revival Party of Tajikistan from the 58 cities and regions on termination its  activities was available to the Ministry as well as:

However, the Supreme Council of the party in conflict with paragraph 2.4 of the Charter of the Islamic Revival Party of Tajikistan  has left these acts without consideration.
Ignore these acts  and the creation of barriers from the side of management of the party to the implementation of the constitutional rights of citizens and the political will of the former members of the party is contradicted to the requirement of art. 28 of the Constitution of the Republic of Tajikistan according to which every citizen has the right to voluntarily enters and leaves the membership. This act is also contrary to art. 5 of the Law of the Republic of Tajikistan  on political parties according to which membership in parties will realized voluntary.
Thus, the Supreme Council of the Islamic Revival Party of Tajikistan mercenary has left without consideration resolutions of the municipal structures  of the Islamic Revival Party of Tajikistan and statements of party members on the termination of their membership will contradicted to the Constitution of the Republic of Tajikistan, Lawof the Republic of Tajikistan  On political parties and the Charter Party.

2. Regarding the termination of the municipal structures of the Islamic Revival Party of Tajikistan  other offenses also occur
According to art. 3 of the Law of Republic of Tajikistan On political parties in the country are created only the Republican Party. According to paragraph 1.1 of the Charter of the Islamic Revival Party of Tajikistan is the party of the Republican Party and is valid on the territory of the Republic of Tajikistan.
The law provides for other provisions in accordance with  the political parties in the regions and cities must have the original organization.
Considering the municipalities listed decree on the closure of the party’s activity the Islamic Revival Party of Tajikistan is contrary to the requirements of art. 3 of the mentioned Law.
In this case, the convening of the meeting of senior management of the party was illegal as activity of the majority structure of the party  has stopped. and their representation was not possible.
Also termination of the municipal party structures in the regions and cities   eliminates the possibility of the party to take conference for the purpose of elections members to the Council of the party.
In this case, conduct the above-mentioned meeting of the Islamic Revival Party of Tajikistan would contradicted to listed laws and the Charter of the party and does not provide legal consequences

 3. August 26 this year, by sign of the first Deputy party the Ministry of Justice received a letter regarding the change of party address.
it should be noted that in accordance with part 2 of art. 6 of the Law of the Republic of Tajikistan  On Political Parties and paragraph 10 of the Charter  of the Islamic Revival Party of Tajikistan location of the party is the injunction of the Charter. Therefore it is necessary to amend the Party Charter for changing the addresses.
According to paragraph 4.5 of the Charter of the Islamic Revival Party of Tajikistan authority to amend the charter party belongs to the party Meeting.
The Islamic Revival Party of Tajikistan is recognized as party with religious feature   but it is not religious organization and does not have the right to perform religious activities.
But the party allowed violations of the law illegal conductreligious practices, public religious propaganda. These actions entailed the adoption of preventive measures by the Ministry of Justice and state bodies.
However the Islamic Revival Party of Tajikistan continued its activity in this field.  In party publications and in own measures by participating majority of citizens  directly conducted religious propaganda, exhorted to obey religious traditions and practices and to pray the Namaz. The Party continue carrying out religious propaganda and other forms of activity of the Islamic Academy  in respect of which the Ministry expressed its distrust. For example its proven by printed material in publications of the Islamic Revival Party of Tajikistan such as the Najot №43 (813) from 23.10.2014, №51 (821) from 16.12.2014, №14(836) from 02.04.2015, №16 (838) from 16.04.2015 and etc.
In accordance with part 9 of Article. 4 of the Law of the Republic of Tajikistan  on freedom of religion and religious association the right to conduct public religious propaganda belongs only religious associations.
In accordance with Art. 2 the Law of the Republic of Tajikistan  On political parties the main purpose of political parties is to participate in the political life of society through the creation of a political will of the citizens.
In this context, consider Islamic Revival Party of Tajikistan as religious associations is illegal because the purpose of a religious party is different from the political parties. But the party using different ways and directions  continue its activity to develop political will of the citizens by using Islam religion which leading citizens to misbelieve about their legal status.
Given the above mentioned and in accordance with art. 20 of the Republic of Tajikistan Law on Political Parties Islamic Revival Party of Tajikistan is notified:
1. The illegal activities of the Islamic Revival Party of Tajikistan is expressed in violation of the requirements of the Republic of Tajikistan Constitution, the Republic of Tajikistan Law on Political Parties and the Law of the Republic of Tajikistan  On freedom of religion and religious association and the Charter of the party and therefore its activity stopped.
2. This notice is considered within 10 days and the Ministry of Justice of the Republic of Tajikistan will notify on its results.
3. In case of failure to comply with the requirements of this notice in the attitude of the party will take measures stipulated by the Republic of Tajikistan Law on Political Parties.
